1. About Hopnest Direct
Hopnest Direct is a technology platform that provides software tools for small stay businesses to manage direct guest enquiries and booking requests.
It is built for homestays, villas, cottages, farm stays, boutique stays, small resorts, and independent accommodation providers.
2. Nature of the Service
Hopnest Direct is a software and technology service only. It is not a travel agency, accommodation broker, booking agent, tour operator, merchant of record, property operator, or representative of any stay owner.
The platform provides digital tools that allow stay owners and guests to connect directly.
Hopnest Direct does not confirm bookings, collect guest payments, process refunds, or handle guest check-in. These responsibilities remain with the stay owner.
3. No Booking Confirmation or Reservation Guarantee
Submitting an enquiry or booking request through a Hopnest Direct page does not create a confirmed reservation.
A booking becomes valid only when the stay owner reviews the request, communicates directly with the guest, and independently confirms the booking.
Hopnest Direct does not guarantee booking confirmations, occupancy levels, guest enquiries, revenue, reservation conversions, property visibility, or business growth.
4. No Payment Collection by Hopnest Direct
Unless explicitly stated for a future feature, Hopnest Direct does not collect guest payments, process deposits, hold customer funds, issue payment receipts, process refunds, or act as a payment intermediary.
Any payment arrangement is made directly between the stay owner and the guest. Stay owners are responsible for collecting payments, issuing receipts, maintaining financial records, processing refunds, and managing payment disputes.
5. Direct Relationship Between Stay Owner and Guest
When a guest submits a booking request, the stay owner may contact the guest directly through WhatsApp or other contact methods provided by the guest.
Any agreement relating to accommodation, pricing, confirmation, deposits, cancellations, refunds, check-in, check-out, house rules, property usage, or additional services is a direct relationship between the stay owner and the guest. Hopnest Direct is not a party to those agreements.
6. Limitation of Platform Liability
To the maximum extent permitted by applicable law, Hopnest Direct is not liable for property condition, cleanliness, safety standards, amenities, maintenance issues, inaccurate listings, guest misconduct, property damage, non-payment, rule violations, fraud, cancellations, refund disputes, pricing disagreements, reservation errors, overbookings, service complaints, business interruption, revenue loss, data loss, reputational damage, or indirect or consequential damages.
7. Stay Owner Responsibilities
Stay owners are responsible for maintaining accurate property name, destination, room details, room count, occupancy limits, pricing information, contact details, photos, amenities, availability status, and booking policies.
Stay owners must ensure that all information published through the platform is truthful, accurate, lawful, and not misleading.
8. Legal Authority to Operate
By listing a property, the stay owner represents that they own the property or have authority to manage it, possess required permissions or registrations, comply with applicable regulations, and do not violate third-party rights.
Stay owners are solely responsible for hospitality, tourism, tax, safety, licensing, consumer protection, and other legal compliance obligations.
9. Prohibited Activities
Users may not publish false information, upload fake property photos, misrepresent availability, engage in fraud, collect guest information unlawfully, transmit harmful code, violate intellectual property rights, harass users, or misuse the platform.
Hopnest Direct may suspend or terminate accounts for fake listings, misleading pricing, fraud complaints, unauthorised property identity use, platform abuse, or legal violations.
10. Guest Information and Communications
Stay owners receive guest information only for legitimate booking-related purposes. They must protect guest information appropriately, comply with applicable privacy laws, and avoid unsolicited marketing without proper consent.
Guests acknowledge that submitting a booking request may result in direct communication from the stay owner through WhatsApp, phone, email, or other contact methods provided during the request process.
11. Intellectual Property
Hopnest Direct software, branding, designs, content, logos, graphics, features, and platform functionality remain the property of Hopnest Direct or its licensors.
Property photos, descriptions, and user-submitted content remain the responsibility of the respective stay owner.
12. Platform Availability
We strive to maintain reliable service, but Hopnest Direct does not guarantee uninterrupted availability. Maintenance, technical issues, software updates, and third-party disruptions may affect access from time to time.
13. Future Features and Pricing
Hopnest Direct may introduce premium plans, paid features, modified functionality, feature limits, and updated pricing. Where reasonably practicable, advance notice will be provided before material pricing changes affecting existing users.
14. Disclaimer, Indemnification, and Changes
The platform is provided on an “as is” and “as available” basis. Hopnest Direct makes no warranties regarding continuous availability, accuracy of user-submitted content, booking success, business performance, revenue outcomes, or compatibility with all devices or services.
Users agree to indemnify and hold harmless Hopnest Direct, its founders, employees, affiliates, contractors, and partners from claims arising from property operations, guest disputes, user content, regulatory violations, or breach of these Terms.
Hopnest Direct may update these Terms from time to time. Continued use of the platform after updates are published constitutes acceptance of the updated Terms.
15. Governing Law and Acknowledgement
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the competent courts located in Kochi, Kerala, India.
By using Hopnest Direct, you acknowledge that it is a software platform only, does not confirm bookings, does not collect guest payments, and is not responsible for stay operations. Booking agreements exist directly between the stay owner and guest.
